Rights and Obligations of the Patient

The general rights and obligations of patients are established in the Law of Obligations Act and the Charter of Fundamental Rights of the European Union.

The patient has the right to:

  • receive emergency medical assistance
  • receive information about their health status, available treatment options, and expected outcomes in a language they can understand
  • ask questions and receive clarification from medical staff if something remains unclear
  • participate in the development of their treatment plan and choose the most suitable treatment option from those available
  • refuse treatment within the limits permitted by law and receive information about the possible consequences of refusal
  • receive necessary treatment promptly, in a safe environment and for an agreed period of time
  • privacy and confidentiality of personal and medical information
  • respectful and dignified treatment that takes the patient’s values and beliefs into account
  • seek the opinion of another doctor for an independent medical assessment
  • apply to the hospital management, the Health Fund, or the Health Board to protect their rights
  • claim compensation for damage caused during the provision of health care (patient insurance)

Obligations of the Patient

The patient is obliged to contribute to achieving the best possible treatment outcome and to:

  • provide the healthcare provider with all known and relevant information about their health condition and illnesses
  • cooperate with medical staff and follow the treatment plan, instructions, and schedule prescribed by the doctor
  • take responsibility for their behaviour and lifestyle choices
  • treat staff and fellow patients with respect
  • respect the privacy, safety, and comfort of other patients
  • keep confidential any information about the identity, private life, or health of fellow patients that becomes known during treatment
  • inform hospital staff of any problems or concerns that arise
  • comply with personal hygiene requirements and the Hospital Rules
  • pay the patient share fee for health care services, where applicable

Patient insurance

Patient insurance, also known as health care provider liability insurance, guarantees patients the right to claim compensation for damage caused during the provision of health care.

As of 1 November 2024, compulsory liability insurance for healthcare providers (patient insurance) applies in Estonia. This insurance covers avoidable harm caused in the course of providing health care.

Data protection

West Tallinn Central Hospital has a legal obligation to protect the privacy of its patients, visitors, and website users. This Privacy Policy explains how personal data is collected, used, disclosed, transmitted, and stored.

Legal bases for processing

West Tallinn Central Hospital is a healthcare provider bound by medical confidentiality obligations. Pursuant to § 11 of the Health Information System Statutes and § 41 of the Health Services Organization Act, the hospital has the right to process personal data, including special categories of personal data, without the consent of the data subject, where this is necessary for the provision of health care.

Data Security

To ensure the security of data stored in the hospital’s information systems, West Tallinn Central Hospital (LTKH) has implemented appropriate measures to protect personal data from loss, misuse, and unauthorized alteration.

  • Access to personal data is restricted to authorised personnel only.
  • Security and privacy policies are regularly reviewed and updated.
  • The hospital’s websites, www.haigla.ee and www.viljatusravikeskus.ee, use an up-to-date SSL certificate, ensuring encrypted and secure (HTTPS) data transmission.
  • LTKH does not disclose website user data to third parties.

Protection of personal data

West Tallinn Central Hospital applies administrative, technical, and physical safeguards to protect patients’ personal data. Access to data processing and modification is granted only to authorised persons.

When we collect and process your data

We collect and process personal data if:

  • you receive treatment at our hospital
  • your loved one is admitted to our hospital
  • the patient has identified you as a contact person
  • you request copies of your medical records
  • you submit an inquiry, request for clarification, or information request
  • you send us a proposal or a letter of appreciation
  • you apply for a job or internship
  • you book an appointment digitally or via the Call Centre (e.g., name, address, phone number, e-mail)
  • you participate in events organised by the hospital (training sessions, seminars, conferences)
  • you visit our website (IP address, location, browser type and version, operating system, visit duration, and page statistics)

Disclosure of personal data

West Tallinn Central Hospital may disclose personal data:

  • where required by law, e.g., to the police, the Health Insurance Fund, the Health Board, or an insurer in the event of an insured incident
  • to protect its rights and ensure security, for example, in cases of suspected fraud

Access to your personal data

You have the right to access personal data collected about you.

  • Requests may be submitted at the registry offices of our units or sent digitally signed to la@haigla.ee.
  • A reasonable amount of data is provided free of charge (up to 20 paper copies per year).
  • Data is issued upon presentation of an identity document or securely encrypted using an identity code.

For data security reasons, personal data and medical test results are not disclosed by phone.

Personal data will not be disclosed if doing so may:

  • infringe the rights and freedoms of another person
  • hinder crime prevention or criminal investigation
  • compromise criminal proceedings
  • jeopardise the protection of secrecy relating to assisted reproduction

Security and surveillance cameras

Surveillance cameras are used to ensure the safety of patients, employees, trainees, visitors, and hospital property.

  • Camera recordings are accessible only to authorised personnel.
  • Recordings are stored for a maximum of 30 days.
  • In some departments, cameras are used to monitor treatment or examinations or to ensure patient safety.
  • Only healthcare professionals involved in a patient’s treatment have access to such recordings.
  • Camera use is clearly indicated by signage throughout the hospital.

Photographing and filming

Photography and video recording in all hospital premises are prohibited without prior approval from the hospital.
